TERMS AND CONDITIONS:
TOUR OPERATOR: Diamond Club Vacations, herein referred to as “Tour Operator”, has arranged the Passover vacation packages described in reservation form/confirmation. Diamond Club Vacations acts as the tour operator for Diamond Club Mexico sponsor of the Grand Hyatt Playa Del Carmen Passover program hereinafter called the Sponsor.
RESERVATION: Reservations are subject to availability and are conditioned upon receipt by us of a deposit in the amount of $3,000 per room. All Early-Bird Specials must be paid in full no later than December 23rd, 2019. Payments received after the above date will be subject to any additional costs incurred or loss of the Early-Bird deal. The balance may be paid by check, money order or cash. Prior to attendance at the program, a major credit card authorization form must be filled out and signed. This is for any incidentals which you or anyone in your party may incur during the program.
PASSPORTS AND TRAVEL DOCUMENTS: Everyone traveling to Mexico (including newborns, infants and children) must have a valid passport. All guests must provide their passports and entry visas at check-in.
CONDITIONS AND RESPONSIBILTY:
Tour Operator is responsible for arranging the Passover Program offered. Every effort will be made to accommodate room requests. However, these requests cannot always be guaranteed with 100 percent certainty due to variables beyond our control and the hotel’s control. Tour Operator in arranging any accommodations or in rendering other services in connection therewith does as agent for the individual desiring such travel accommodations upon the express condition and your agreement and understanding that that neither the tour operator nor the sponsor shall be liable for, AND YOU HEREBY RELEASE US: from any injury, loss, damage, accident, delay, irregularity or expense arising from the use of any travel or lodging facilities, accommodations or services provided in connection with such individual’s travel plan, for any injury, loss, damage, accident, delay irregularity or expense arising from strikes, war, weather, quarantines, pandemic, sickness, government restrictions or regulations, from any act of omission by individual, or corporation furnishing transportation, sightseeing, hotel accommodations or any other services in connection therewith, for any additional cost or expense due to disruption or change of advertised schedules, rates or services or for any cause.
Due to the current situation with COVID-19 and in an attempt to give our guests maximum comfort, we have extended our final payment dates. We ask that our guests adhere strictly to the schedule below:
Deposit is fully refundable until January 20, 2021.
50% of invoice total is due on January 20, 2021 (non-refundable).
Final balance due on March 1, 2021 (non-refundable).
Once the program is in progress, no refunds are considered. Cancellations must be made directly with us and must be received in writing at our office before they will be acknowledged. Please be sure to obtain proof of mailing when cancellation penalties are in effect. This cancellation policy is strictly adhered to and reflects the risks and costs associated with the program. Reservations are non-transferable and group cancellation policies may differ.
We strongly recommend that you buy travel insurance. Tour Operator holds the rights to cancel this program for any reason for a full refund and/or make any alterations necessary for the proper operation of the program. Tour Operator will not be liable for loss of travel tickets.
VIDEOTAPE/ PHOTOGRAPHIC RELEASE:
By virtue of your presence, you understand and give permission for you to be photographed or videotaped and you give permission to use photographs or videography without limitation. You explicitly release Tour Operator from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of your picture, voice or likeness.
Any dispute arising between Tour Operator and participant, or relating in any way to the travel envisaged by this document or the confirmation shall be resolved in arbitration before the Beth Din of America (affiliated with the Rabbinical Council of America). The parties consent to the jurisdiction of the courts of the State of New York for the purpose of enforcing any determination of the Beth Din, and enforcing this arbitration clause. Any arbitration with respect to a dispute relating to the travel envisaged by this document or the confirmation shall be commenced within two months of the last day of the event.
